This is the most ridiculous, fucked up story I've heard in a long time. If this was my kid I would be Homicidal.

MARIETTA — Cobb County and Marietta police arrested a surgeon in the emergency room of WellStar Kennestone hospital, resulting in the death of 16-year-old soccer player, according to a lawsuit filed last week.

Brad Dalton of Marietta died Sept. 30, 2001, from a brain injury he received while playing soccer. He was rushed to the hospital where neurosurgeon Dr. Daniel Moore was paged to report to the hospital for emergency surgery.

The doctor never made it to the operating table because police chose to arrest him in the emergency room on charges he fled a parking lot fender-bender, the lawsuit states.

Both Marietta Police and Cobb County Police were involved in the arrest, according to the wrongful death lawsuit, which was filed against both departments and the hospital.

“We’ve done a good deal of research, and I’ve never seen a case like this before,” said Brad Kaplan, an attorney with the Atlanta firm Kaplan and Seifter.

“The Daltons deserve some answers, and we’re going to try to get them those answers. This couple is sitting in a waiting room, waiting to hear from a neurosurgeon about whether or not their boy is going to survive, and this neurosurgeon is arrested.”

The lawsuit states the doctor should have been allowed to proceed with the operation because he did not pose a significant threat of flight.

According to Kaplan, as Moore was leaving the parking lot from a Marietta grocery store, a woman in an SUV blocked his car and said he had hit her. Moore told the woman he was on his way to a hospital emergency and said he did not feel any impact from a crash and there did not appear to be any damage, he said.

She then told the doctor she was calling the police, and they both left the parking lot, Kaplan said. Moore, too, used his cell phone to call the police to tell them about the alleged accident and that he was on his way to an emergency operation at the hospital.

The woman followed Moore all the way to Kennestone Hospital. As he was inside preparing to operate, a Marietta police officer and a Cobb County officer arrived at the scene, Kaplan said. The driver of the SUV had found Moore’s Mercedes in the parking lot and notified hospital security.

A hospital security guard and Marietta officer Kim Thomas, who is no longer with the department, detained Moore in the security office even though he said he told them he was attending to a critically ill patient, the lawsuit states. He was arrested and driven away in a Cobb County police car and taken to the county jail, Kaplan said.

“By the time they placed Dr. Moore in custody,” he said, “they knew his name, address, car tags, and location of his practice, so how could there have been any kind of fear of flight?”

The hit-and-run charges against Moore have been dropped because the alleged victim has moved out of Georgia and is not willing to come back to testify in court.

Even though Moore was able to reach his practice by phone to find another surgeon to perform the procedure, Brad Dalton died.

Kaplan said the delay in treatment is what led to Dalton’s death.

“Timing was critical,” he said. “This was an emergency procedure to place a valve in Brad’s brain that would relieve the building pressure. The quicker it goes in, the less pressure, the greater the chance of survival.”

Kaplan said the lawsuits underscore what a city or county can be held responsible for and determine how great their protection is against liability claims.

None of the defendants have responded to the lawsuit yet. Marietta City attorney Doug Hainey said he could not comment because it is a pending legal matter.

Cobb County spokesman Robert Quigley said, “We’ve got the suit and we’re reviewing it. We are of course saddened by the death of the young man. But at the same time, our officer was performing his duty and was not responsible for the death of the child.”

Wellstar issued the following statement: “We were just served in this case and are in the process of searching for legal counsel. Therefore we cannot comment at this time.”

Officials with Cobb County Police could not be reached because of the Thanksgiving Holiday.

Cops playing lord and master again. Stuff like this is what makes some people have such a low impression of them. "Just doing my job". Calling it your job doesn't make it right or inteligent.
 
No amount of money would replace the loss of a child but these parents should get truckloads
 
What goes around comes around, one day those cops might need a doctor, ambulance, or something, and they might get help up on bullshit too.

what is ironic, is the lady that started all this by calling the cops, now doesn't even care enough to come back and testify. In essence, this all happened for nothing
