Anyone ever sue anyone personally?

I've always said I'm not the suing kind, but I have an ex GF who owed me 10K, paid half it and split to another state and is playing hard ball w me, bringing all the personal shit up from years ago. So I'm out 5K and after many emails being very diplomatic, not calling names and sticking to my guns with a paper proof that she still owes me, I'm kind of at a loss if I should resort to small claims court

She does have some shit on me as she knows I have paid some my employees (including her when she worked for me) cash. so in theory she could blow the whistle on me. She has quite replying to my emails and wont pick up her cell.

I realize I would have to pay court costs initially which I would pass on to her, plus my attorney fees, so I would think 5K could be 6K in a hurry. But I have nothing signed other than emails from her acknowledging her balance was 10K, I doubt she would drive back for any court hearings. I assume this responsibilty for this, just was trying to help her thru a tough time

5K a good chunk of change to let slide, anyone ever go thru this??
 
So, was this an agreement (i.e. loan)? If so, and you can show it (which it seems you can), then you have a claim.

Does paying her and your employees cash have anything to do with your agreement with her? If not, then it will have absolutely no bearing on the outcome of the case. The court won't even consider it.

The challenge is personal jurisdiction. If she is a resident of this other state, you'll almost certainly have to bring the case where she lives, and that could be annoying. Then, once you get your judgement, you'll have to arrange to collect on it. If she pays, great. If not, you'll have to enforce the order by garnishing her wages etc. (which isn't hard, but it does require more paperwork [and $$$] with the courts).

In sum, on the surface, you can probably pursue a remedy with the courts. The question is whether this it's worth the 5k.

I have check dates, ck numbers and amounts and several emails where she acknowledges she owes the amount

I was concerned w her turning me into Uncle for paying cash under the table but I would think Uncle Sam gets a lot of those and cant follow up on all them

Are you sure I would have to travel to where she lives for court? Its like 150 miles away, if thats the case, maybe I be better either going thru a local attorney in her state where I dont have to travel to OR turning her into a collection agency OR I could do nothing and let the Karma Gods deal w her!
 
Yeah, sounds like you can show there was an agreement and that she breached that agreement...

can I roll court and legal costs into the suit? Or must it be for the face amount? Or can I have attorney send letter informing her of the additional costs if she doesnt make attempt to pony up?
 
You might be able to recover some court fees, but that depends on local rules. It's very unlikely that you'll be able to recover attorney fees (also depends on local rules and of course, the facts of your case). I'd estimate that out of that 5k, you might see 1-2 of it a the end of the day.

But again, a consult with a local attorney is a real good idea.
 
Yeah you won’t get half the dough back brutha! I’m not sure how person to person suits are but I sued a business that settled out immediately and lawyer took 33% of entire settlement and that didn’t include his investigators who did interviews and such

I wouldn’t bother with it if it were me

I suppose considering she has info on me that would far exceed 5K, I suppose yr right. She did finally reply to me this morning via email that she would get back w me in a few days, not that I expect much progress

Having a kind heart comes w a price, I like helping people out but at times its a curse. Its just in this case I helped her w her utilities, her phone, her property taxes etc and to think she would do this to me is really upsetting, not to mention she tries to justify it with sour grapes from our dating yrs. In my biz when the slow time comes and I would need some extra cash, having 5K sure would be of great help.....now looks like it wont be there

Thats why why I refuse to loan anyone money! Especially friends and family! I’ll loan a stranger before I loan them! One of my best friend I loaned and when I asked for it back he said his girl said they shouldn’t and aren’t paying me back because and I quote “you have money so we don’t think we should pay you back” lol

jaw dropping shit ! And I didn’t nor don’t have money like that lol it was just a piss poor excuse and I haven’t spoken to them since and that was 16 years ago

so believe me I know how u feel
 
know the feeling, family and friends will sure take advantage of you. in a heartbeat and act like they did nothing wrong.

trying to work it out diplomatically, at least she is replying although rather confrontational. She really is in control hence the saying of using honey over vinegar.

Thing is she was a master of promotions, in fact my membership was at all time high when she was working for me, so maybe just maybe she be up for some type of swap for marketing esp on social media as I totally suck at that

I am a independent contractor paralegal. I have sued many times in small claims court. I am currently suing an attorney who owes me $63,000 for fees she failed to pay me in a probate matter back in 2014. Adding in 10% per year pre-judgment interest, this bitch will owe me around $80,000 when I get a judgment against her My deposition is set for tomorrow.
