S. 2195, the Anabolic Steroid Control Act of 2004, was signed by President Bush on Friday, October 22. It is amazing that only 14 years earlier, in 1990, anabolic steroids were first declared by Congress to be controlled substances. In 90 days, around January 20, 2005, andro, methyl-1-test, and other popular pro-hormones will be included in the same law as cocaine and heroin. (Yes, we are living in the United States). Like pharmaceutical steroids, most pro-hormones will be in the same class as barbiturates, ketamine, LSD precursors, and narcotic painkillers such as Vicodin.
This bill, which was introduced by Senators Joseph Biden (D-Del.) and Orrin Hatch (R-Utah), provided for the listing of steroid hormone precursors such as androstenedione ("andro") under the Controlled Substances Act. Such action effectively prohibits the marketing of these substances as dietary supplements by regulating them as Schedule III controlled substances. The U.S. Anti-Doping Agency (USADA) has called steroid precursors "the functional equivalent of steroids."

Congressman John Sweeney, another sponsor of the bill has said "Today is a great victory for parents of athletes everywhere," said Sweeney. "No longer will these dangerous products be marketed to our nation's youth, many of who are unaware of their harmful side effects. Starting today, we've made it a little easier for parents in their continuing struggle to keep their children safe from the dangers of illicit drugs." The new law also provides $15 million for educational programs for children about the dangers of anabolic steroids, and directs the U.S. Sentencing Commission to consider revising federal guidelines to increase the penalties for steroid possession and distribution.

According to steroid legal expert Rick Collins [www.teamlegalmuscle.com], the law adds 26 new steroid compounds to the previous list of substances that are legally defined as "anabolic steroids" and classified as Schedule III controlled substances. Mere possession of any of these products will be a basis for arrest and prosecution as a federal drug criminal. The new compounds are: androstanediol; androstanedione; androstenediol; androstenedione; bolasterone; calusterone; *1-dihydrotestosterone (a.k.a. "1-testosterone"); furazabol; 13b-ethyl-17a-hydroxygon-4-en-3-one; 4-hydroxytestosterone; 4-hydroxy-19-nortestosterone; mestanolone; 17a-methyl-3b,17b-dihydroxy-5a-androstane; 17a-methyl-3a,17b-dihydroxy-5a-androstane; 17a-methyl-3b,17b-dihydroxyandrost-4-ene; 17a-methyl-4-hydroxynandrolone; methyldienolone; methyltrienolone; 17a-methyl-*1-dihydrotestosterone (a.k.a. "17-a-methyl-1-testosterone"); norandrostenediol; norandrostenedione; norbolethone; norclostebol; normethandrolone; stenbolone; and tetrahydrogestrinone. Some of these new substances have been widely marketed as dietary supplements. Others are actually very old pharmaceutical steroids that were missed in the original federal law.

Rick Collins points out that the law also changes the general requisite elements of an anabolic steroid. The "promotes muscle growth" language that preceded the list of compounds in the 1990 law is now removed from the statute. Strangely, an anabolic steroid, under the new law, need not be anabolic. The omission of the criterion of promoting muscle growth profoundly impacts the process by which a newly created "designer" steroidal compound may be scheduled. "Even under the 1990 law, the Attorney General had the authority under 21 U.S.C. § 811 to schedule additional or newly discovered steroidal compounds without going back to Congress for approval. However, under the old law, in order for a compound to qualify as an anabolic steroid, the Attorney General was required to prove that the compound had anabolic properties. Under the new law, the Attorney General must only establish that the compound is chemically and pharmacologically related to testosterone."

What can we expect from the new law? The politicians behind it apparently believe that it will curtail steroid use in athletics. While their hopes are well-intentioned, Collins says that if past experience serves, such hopes seem doubtful. "The original 1990 law was pitched to the public as a solution to steroids in sports. However, not only has steroid use by athletes continued, but judging from the unprecedented frenzy over the issue this past year the problem appears much bigger than ever."

What the law will do, according to Collins, "is put an end to most (although not all, at this point) legal steroidal dietary supplements, leaving black market steroids as the remaining option. While increased penalties for steroid possession will deter some, others will flock to the black market." Collins predicts a rise in the use of illegal steroids. "Prohibition always has a cost."

SEC. 2. AMENDMENTS TO THE CONTROLLED SUBSTANCES ACT.

(a) DEFINITIONS- Section 102 of the Controlled Substances Act (21 U.S.C. 802) is amended--

(1) in paragraph (41)--
(A) by realigning the margin so as to align with paragraph (40); and
( by striking subparagraph (A) and inserting the following:
`(A) The term `anabolic steroid' means any drug or hormonal substance, chemically and pharmacologically related to testosterone (other than estrogens, progestins, corticosteroids, and dehydroepiandrosterone), and includes--
`(i) androstanediol--

`(I) 3b,17b-dihydroxy-5a-androstane; and
`(II) 3a,17b-dihydroxy-5a-androstane;
`(ii) androstanedione (5a-androstan-3,17-dione);
`(iii) androstenediol--
`(I) 1-androstenediol (3b,17b-dihydroxy-5a-androst-1-ene);
`(II) 1-androstenediol (3a,17b-dihydroxy-5a-androst-1-ene);

The substances excluded under this subparagraph may at any time be scheduled by the Attorney General in accordance with the authority and requirements of subsections (a) through © of section 201.'; and

(2) in paragraph (44), by inserting `anabolic steroids,' after `marihuana,'.
( AUTHORITY AND CRITERIA FOR CLASSIFICATION- Section 201(g) of the Controlled Substances Act (21 U.S.C. 811(g)) is amended--

(1) in paragraph (1), by striking `substance from a schedule if such substance' and inserting `drug which contains a controlled substance from the application of titles II and III of the Comprehensive Drug Abuse Prevention and Control Act (21 U.S.C. 802 et seq.) if such drug'; and
(2) in paragraph (3), by adding at the end the following:
`© Upon the recommendation of the Secretary of Health and Human Services, a compound, mixture, or preparation which contains any anabolic steroid, which is intended for administration to a human being or an animal, and which, because of its concentration, preparation, formulation or delivery system, does not present any significant potential for abuse.'.
© ANABOLIC STEROIDS CONTROL ACT- Section 1903 of the Anabolic Steroids Control Act of 1990 (Public Law 101-647) is amended--
(1) by striking subsection (a); and
(2) by redesignating subsections ( and © as subsections (a) and (, respectively.
(d) EFFECTIVE DATE- The amendments made by this section shall take effect 90 days after the date of enactment of this Act.
SEC. 3. SENTENCING COMMISSION GUIDELINES.

The United States Sentencing Commission shall--

(1) review the Federal sentencing guidelines with respect to offenses involving anabolic steroids;
(2) consider amending the Federal sentencing guidelines to provide for increased penalties with respect to offenses involving anabolic steroids in a manner that reflects the seriousness of such offenses and the need to deter anabolic steroid trafficking and use; and
(3) take such other action that the Commission considers necessary to carry out this section.
SEC. 4. PREVENTION AND EDUCATION PROGRAMS.

(a) IN GENERAL- The Secretary of Health and Human Services (referred to in this Act as the `Secretary') shall award grants to public and nonprofit private entities to enable such entities to carry out science-based education programs in elementary and secondary schools to highlight the harmful effects of anabolic steroids.

( ELIGIBILITY-


(1) APPLICATION- To be eligible for grants under subsection (a), an entity shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.
(2) PREFERENCE- In awarding grants under subsection (a), the Secretary shall give preference to applicants that intend to use grant funds to carry out programs based on--
(A) the Athletes Training and Learning to Avoid Steroids program;
( The Athletes Targeting Healthy Exercise and Nutrition Alternatives program; and
© other programs determined to be effective by the National Institute on Drug Abuse.
© USE OF FUNDS- Amounts received under a grant under subsection (a) shall be used primarily for education programs that will directly communicate with teachers, principals, coaches, as well as elementary and secondary school children concerning the harmful effects of anabolic steroids.
(d) AUTHORIZATION OF APPROPRIATIONS- There is authorized to be appropriated to carry out this section, $15,000,000 for each of fiscal years 2005 through 2010.

SEC. 5. NATIONAL SURVEY ON DRUG USE AND HEALTH.


(a) IN GENERAL- The Secretary of Health and Human Services shall ensure that the National Survey on Drug Use and Health includes questions concerning the use of anabolic steroids.
( AUTHORIZATION OF APPROPRIATIONS- There is authorized to be appropriated to carry out this section, $1,000,000 for each of fiscal years 2005 through 2010.

I'll never understand why governments argue over dumb shit like Pot, Gay Marriage and Supplements, while they could be fixing health care, the education system and spending Police time and money on catching real criminals like rapists, child molesters and guys who beat their wives, not 18 year olds smoking pot in their backyard and people using gear to build some muscle in their own basement..........

Maybe we could get them back like the public did when they tried to ban saccharin. Saccharin was banned because it "caused cancer" in rats. What they didn't say at the time of the ban was that the doses the rats were given were around 1000 times the normal amount of a "dose." (There are numerous substances that we ingest all the time that if taken in that amount, they'd cause cancer too!) The public found out the faulty info that the ban was based on, and petitions were circulated. After they had enough names or whatever the full process was, the people were able to reinstate the use of saccharin.

Maybe there needs to be a truth info campaign for these substances, including regular steroids so we can educate the public. Not sure how to do that, but it's a starting point.
 
All this will do turn people onto steroids, people who otherwise would have gone to GNC or mail ordered a once legal pro-hormone. It will also make lots of dealers rich. I think the better method would be to make all AAS legal for athletic purposes but require that a doctor prescribe them and monitor your health.

But, yeah it sucks and I'm sure you can expect to read alot more about seizures, controlled deliveries, busts, etc next year after this bill goes into effect. Don't they see that people will simply seek the next best things since both will be illegal? What ever? It doesn't make sense to me at all.
 
They think they are protecting kids and teenagers??? Ha! The kids see that no athletes are dying from roids, only the hard street drugs. They do see Barry Bonds hitting his way into the record books making millions, the big-name pro wrestlers with roided physiques making millions, etc., etc. The kids/teens are not stupid. Soon, they will all question why the stupid idiots who pass these type of laws get away with it in the first place. What is the first thing a teen does when you tell him/her not to do something? That its BAD? They are going to do it! Because they see that mature adults do these things and bad things are not happening to them! The kids need to be PROPERLY INFORMED in school and elsewhere about all these types of meds. Just banning them and making them illegal will not make anyone "safe" from them...especially kids. What stupid idiots!!!

Yeah but we vote them into office or allow them to stay there. The lifestyle we choose is one we can't form a union or a lobby and bother senators and congressmen/women to vote our way. Nor would we want to make ourselves easy targets to be hunted down. It sucks but true.

I do agree there are much better things that could be done with police time and tax money though. Far better and more helpful, prosperous things such as protecting our children, getting criminals off the streets, stopping murders, etc, etc, etc!!
