I am so pissed off

I just have to ask if this seems right to any of you. About 2 or 3 weeks ago my uncle got into a car accident. THis girl was going about 80mph in a 35mph she hit my uncles truck head on he was in the back of the truck. When she hit him he flipped out and his truck ran him over. (he was on the side of the road cause he sells produce) Well he had a lot of damage to his body his ribs were broken his organs were messed up he had a lot of things wrong with him. Well needless to say he died this morning. What pissed me off is that the girl that hit him wasn't charged for anything, the cops are saying it was hit fault. She is 16 years old and had no fucking insurance on her car. I think the family should pay his medical bill (there is a hell of a lot) I think she should go to jail cause she did kill him. My family is going to go to court to fight the fact that the police is says my uncle is the one at fault, they said that he was in the road. When she hit him his truck rolled in the road. They said that it was there when she hit him. I think this is all bull shit, just want to know what other think about this.

That's bull shit. try and find some customers that will testify that he was off the road. If there was any skid marks they can be measured for rate of travel(speed) she was going. Check into her family history and see if there are any ties for the special treatment she is getting.

they have 3 witnesses that said they would testify if they had to. I just think this whole mess is a bunch of shit.

i think you need to hire an investigator. they can tell by the skidmarks where the vehicles were when the accident occured and how fast they were going. i believe she should get nailed for manslaughter. you can file your own paprs against her if the d.a. isn't willing to. please talk to a lawyer while all the facts are fresh in your witnesses minds.

So sorry to hear about your loss......If no criminal charges are filed I don't think there is much that can be done.
Get a lawyer and file a civil suit.

Man, that is a SAD story- goes to show how messed up the system is and dont even get me satrted. Hopefully they can go to court and get it resolved but the hassel of just doing that sucks I know- hope it all workds or for them man. Stay possitive.

Munkeee de Sade - Sorry to hear of your families loss. The criminal and civil aspects of this can be related but can also be pursued separately. On the criminal side find out who the investigating officer was and who their boss is. POLITELY give them the names of the witnesses who can give first hand information. Ask for a return call after they look into it. That may change their position on any possible charges.

Secondly if you hire an independent investigator - make sure it is someone who has experience reconstruting veh. accidents. If there is no insurance coverage involved, and if the driver was 16 beware - an investigator will probably want funds up front to do the work, and you may never get it back. When insurance is involved there is more motivation for investigators and attorneys to get involved without charging up front as they will have you guarentee them a percentage of the final claim payment. Might not seem fair, but that's how the industry works. Without insurance and with a 16 year old there just may not be any assets to pay a claim with. 100% of nothing will end up as nothing, but double check that there really was no insurance.

Also your uncles veh insurance may provide some coverage and benefits here. If it does they will pay the beneficiaries now and try to go after the other driver to get it back - but that will be their effort and expense not your families. Good luck.

As far as I know they are going to talk to a lawyer after the funeral tomorrow. I just don't think any of this is right.

I think all my cousin wants is for someone to pay the medical bills, he was in ICU for 2 weeks hooked up to so many different things and she thinks that someone other than herself should pay them. Honestly I think the girl that hit him should pay or her parents since she was 16 I think she should go to jail also.

I have to also say to Harvey thanks for being here for me. I am glad you will be going with me to the funeral. Thank you for taking me to the hospital to see my uncle. You are a great person thank you so much! You don't know how greatful for you. This mean a lot to me that you have been with me listening to me bitch about everything that was going on with my uncle thanks fo rthe support as well.

Been away for a few days Munkee. So very sorry to hear of your uncle's death. It must be very difficult to have to deal with legal issues while trying o get through this difficult time.
If you don't get satisfaction through the criminla aspect, then (and even if you do) persue a civil case. She is responsible for her actions, and her parents are responsible for her since she is a minor.
