Eager smoker stabs woman US on train: News24: World: News

New York - A woman was stabbed in the face with a pen on a New York City subway train after she tried to stop a man from lighting a cigarette.

The assault occurred on a crowded No 3 train near the Chambers Street station during Tuesday's morning rush. Smoking is not allowed on the trains.

Witnesses told the Daily News and the New York Post that an argument quickly escalated when Evelyn Seeger asked the man not to smoke. The witnesses say two riders were trying to restrain the man when he pulled out a pen and slashed Seeger's face.

Seeger was treated at a hospital and released.

Police charged the man with felony assault and criminal possession of a weapon.

big tough guy assaulting a WOMAN.... with a PEN!! There are soooo many people mixed in our society that need institutionalizing in a BAD way. This shit-bag is one of them

Deranged dude that's for sure. Im confused tho, why was he charged with criminal possession of a weapon? Do we need a permit to carry a Bic bald point pen now? Homeland Security better beef up if/when cig prices keep rising! I'm glad the woman was not serious injured or lost an eye because of this low life. Tren and cigs don't mix boys!

I was trying to wrap myself around that too, im guessing no matter what the object is (as long as it has the potential to damage) if it used in that manner will conclude with a felony as the result

Exactly, as I too thought more indept in regards to the statue and nature of this charge.

Any object with intent to cause bodily harm or inflict damage on someone, can/will be considered as a possible weapon. Always a twist in the laws for big brother to manipulate, however it was beneficial here and just for this woman at the end of the day.
Now for me, I will think twice now before I decide to poke someone's eyeball out with my spork or wooden Italian-ice stick at the next beach bash that gets out of hand with a loud mouth drunk.:shocked:

a friend of mine who also studies BJJ choked a guy out with his own coat (lapel choke) and when it went to court they tried to charge him with it...that charged was dropped

but they still nailed him with 3 years probation

Your spot on, had a similar situation in my driveway. I did a stand Ezekiel Choke, 2nd degree charge was dropped to a 4th. What a joke, and none got hurt and the situation was defused in the matter of secs. If it wasn't for my choke I applied who knows what would have happened.
 
It's crazy that anything can be considered a weapon, but saidly it's true. Just shows how fucked up the system is that they can get away with that, but I guess that'll always be the case
